Peter Hime's Bio
Peter Hime qualified as a Kenyan Advocate in 1970 and joined Kaplan & Stratton in the same year. His work encompasses intellectual property and general commercial law. He heads the firm’s Intellectual Property Department and jointly heads the firm’s Corporate Commercial Department. His areas of expertise includes trade marks, copyright, patents, industrial designs, anti-counterfeit law; aircraft leasing and financing; the registration and de-registration of aircraft; distributorship agency and other related commercial arrangements; intellectual property and technical know-how licensing and transfer agreements, franchise agreements, computer software and hardware supply, installation and maintenance contracts.

EXPERIENCE
- Defending a client in the FMCG sector, before the Assistant Registrar of Trade Marks, against cancellation proceedings of their registered marks.
- Instituted opposition proceedings on behalf of our client, in the food manufacturing industry, against an application for a similar mark. The client obtained a successful outcome as the applicant withdrew the application.
- Defending a client in the education sector in opposition proceedings filed by a competitor. The competitor objects to our client’s trademark application.
- Defending an expungement action of our client’s registered trade mark in the telecommunication and computer equipment sector.
- Advising on various trade mark, patent, copyright and industrial design registrations.
- Providing technical know-how as well as advising on licensing, assignment, franchise and management agreements.
- Advising overseas aircraft leasing companies and overseas banks on aircraft leases, registration of aircraft mortgages, registration and de-registration aircraft in Kenya, realisation of securities and repossession of leased aircraft and Kenya tax provisions applicable to aircraft and equipment leases, drafting aircraft leases for local companies and drafting aircraft mortgages for local banks.
- Contributor to the Kenyan chapters to two publications of the International Trade Mark Association in USA. These involve providing regular updates on Kenya trade mark law, assignment and licensing requirements.
- Advising clients on anti-counterfeiting law in Kenya and remedies available.
